TERMS AND CONDITIONS
This English text is a translation of the Romanian version. The Romanian version is the reference version and prevails in case of any inconsistency.

1. Introduction
These terms and conditions (“Terms and Conditions”) set out how you may access and benefit from the services provided by Fcube Data Lab S.R.L., a Romanian limited liability company with its registered office in Bucharest, Sector 2, 1 Thomas Masaryk Street, Building 1, Entrance A, Floor 2, Apartment 5, Office 2, registered with the Bucharest Trade Registry under no. J2025059084009, having European unique identifier ROONRC. J2025059084009 and tax identification code RO52291263, e-mail: support@promoscore.io (hereinafter referred to as the “Company” or “we”), through our Promoscore mobile application.
Promoscore is available in Romania, Hungary and Poland.
By accessing or using the Promoscore application, you declare that you have read, understood and agree to fully assume the provisions of these Terms and Conditions.
Our Services are not available to persons who are under 18 years of age.
2. Our Services
The Promoscore mobile application is intended to optimize your shopping and provides you with free digital tools for quick access to the prices and promotions available in the displayed stores and for managing your shopping budget (the “Services”).
In order to fully benefit from our Services, you must indicate the locality or area where you are located. Without a location, you will be able to access only part of our Services.
With the Promoscore search engine, you can compare the prices of the products you want and view promotional catalogues and offers available in online stores and stores near you, as displayed in the application. You may also search for offers and promotions by product category or by each store in the application, depending on your location.
In addition, by scanning products in the application, you can instantly find the prices available in nearby stores included in the application.
With Promoscore, you can store and manage coupons issued by third-party stores, including SGR. You may use these coupons for your own shopping directly in stores or share them with members of your household or with other users. You may also claim and benefit from coupons shared by other users of the application, to the extent that they are transferable and valid.
REQUESTING OR ACCEPTING MONEY OR OTHER CONSIDERATION FOR SHARED COUPONS AND VOUCHERS IS PROHIBITED.
All coupons that contain a barcode or QR code and provide a benefit are accepted and may be uploaded to the application.
For the protection of your personal data, WE DO NOT RECOMMEND sharing with other users nominal coupons and vouchers or those that contain other personal data.
With Promoscore, you can also store and manage your loyalty cards issued by third-party stores. The cards may be used by you or shared with members of your household exclusively for purchases directly from stores and for price simulations.
You can create your shopping list directly from the application, with the possibility of viewing the prices available for the selected products, as well as any discounts applicable based on the loyalty cards and coupons you have stored/accumulated.
To ensure the accuracy of your shopping list, make sure that the issuing stores are available in the application.
Promoscore helps you manage your shopping budget and monitor your expenses, with the possibility of uploading and storing receipts.
The simulation and management of your shopping budget takes place based on statistical data and, where applicable, your answers to our preliminary questions.
If you have answered our preliminary questions, we may provide personalized shopping recommendations and shopping budget simulations.
To monitor and update your shopping budget, you must upload receipts representing your expenses to the application.
Promoscore gives you access to our community, where you can share information about offers and promotions and share coupons and vouchers.
Promoscore allows you to add other users (usually your family members) in order to share information relating to your shopping and preferences.
The Services are subject to these Terms and Conditions. From time to time, we may also offer you other additional services, and such additional services will be considered Services within the meaning of these Terms and Conditions, whether or not they are specifically defined in this document.
3. Access to the application
To access the Promoscore mobile application, you may authenticate with your e-mail address or with your Apple, Google or Facebook authentication credentials.
4. Assumption of risk and your responsibilities
You accept and acknowledge that you are solely responsible for the actions you take in your own Promoscore account and that your use of our Services is exclusively at your own risk.
You accept and acknowledge that you are solely responsible for the security of your Promoscore account access data.
You warrant that the actions you take in your own Promoscore account will not breach these Terms and Conditions and will not affect the intellectual property, publicity or confidentiality rights of third parties, will not breach the provisions of any applicable law or regulation, and will not promote illegal, discriminatory, misleading, defamatory, obscene or offensive activities or materials.
BY SHARING COUPONS AND VOUCHERS WITH OTHER USERS, YOU WARRANT THAT THEY ARE AUTHENTIC, REAL, ACCURATE AND NOT MISLEADING, AND THAT YOU WILL PROTECT THE COMPANY FROM ANY LIABILITY OR DAMAGE IN CONNECTION WITH THEM.
If these warranties are breached, we reserve the right to suspend or close your Promoscore account without any prior notice.
5. Disclaimer
Promoscore operates as an informational platform for public promotions available in physical stores, online stores and stores’ mobile applications, without guaranteeing the accuracy or availability of the displayed prices and offers, which are based on public data and the stores’ own rules.
We are not liable for unavailable promotions or pricing errors, nor for the validity of coupons or vouchers shared by other users, especially if they are nominal, non-transferable or may be associated with personal data.
USERS ARE WARNED THAT SHARING VOUCHERS AND COUPONS THAT CONTAIN OR MAY BE ASSOCIATED WITH PERSONAL DATA INVOLVES RISKS, AND RESPONSIBILITY LIES EXCLUSIVELY WITH THOSE WHO SHARE OR USE THEM.
Information, promotions, coupons or cards originating from third parties, including users or stores, are taken over and presented as such. Responsibility for their accuracy, legality and validity belongs exclusively to the issuer or to the user who shared them.
The Company does not issue, manage or trade promotions or coupons, and their use is subject exclusively to the rules of the issuing stores. The Company assumes no liability for the impossibility of accessing or using offers, nor for the consequences resulting from the voluntary disclosure of personal data to other users.
We do not guarantee the continuous or error-free operation of the application, including access to information relating to promotions, prices or specific features, which may be affected by technical problems, connectivity issues or third-party errors.
YOU ACCEPT AND ACKNOWLEDGE THAT, TO THE EXTENT PERMITTED BY LAW, THE COMPANY WILL NOT BE RESPONSIBLE AND WILL NOT BE HELD LIABLE FOR ANY LOSS SUFFERED, DIRECTLY OR INDIRECTLY, BY YOU AS A RESULT OF USING THE SERVICES.
YOU HEREBY EXPRESSLY WAIVE ANY CLAIMS AGAINST THE COMPANY IF YOU CAN NO LONGER ACCESS YOUR PROMOSCORE ACCOUNT.
6. Intellectual Property
As between you and the Company, we exclusively own all rights, titles and interests in and to the Promoscore application and the Services available within it, including all content, code, data and materials related to them, the look and feel, design and organization of the Services or any aspect thereof, as well as any copyright, trademark, our name and logo, any patent, database and any other intellectual property rights and related rights (“Our Intellectual Property”). Your use of our Services does not grant you ownership of Our Intellectual Property.
Copying, reproducing, distributing, publishing or otherwise exploiting the rights relating to Our Intellectual Property is prohibited without our prior written permission.
By making any content available through the Promoscore application, you grant the Company a non-exclusive, transferable, worldwide license, with the right to sublicense, to use, copy, modify, create derivative works from, distribute, publicly display and publicly promote your content in connection with the operation and provision of the Services.
The Company may remove any content that does not comply with these Terms and Conditions, without being liable to you for any loss you may suffer as a result of such removal.
7. Personal data protection
Your personal data will be processed by the Company in accordance with our Privacy Policy.
8. Third-party services, content and promotions
When you use any of our Services, you may also use the products, services or content of one or more third parties. Your use of such third-party products or services may be subject to separate policies, terms of use and fees belonging to those third parties, and you therefore agree to comply with and assume such policies, terms of use and fees, as applicable.
We assume no responsibility for the use of services provided by third parties in connection with our Services.
Our Services may contain references or links to third-party sources, including, but not limited to, information, materials, promotions or content that we do not own or control. We do not approve, monitor, endorse or guarantee, and we assume no responsibility for, such sources or promotions.
YOU ACKNOWLEDGE THAT YOU ASSUME EXCLUSIVE RESPONSIBILITY AND ALL RISKS ARISING FROM ACCESSING AND USING ANY SERVICES AND RESOURCES PROVIDED BY THIRD PARTIES.
9. Changes
The Company has the right to make any amendments to these Terms and Conditions without your consent. Such changes will enter into force on the date they are published in the application.
10. Termination and suspension
The application may be modified periodically, and some functionalities or Services may be removed, suspended or updated without prior notice and without you being able to request compensation for these changes.
We reserve the right to suspend, deactivate or terminate your ability to access or use the Services at any time and for any reason or for no reason, without you being able to request compensation for these changes.
11. Severability
If any clause of these Terms and Conditions is invalid or unenforceable, its subject matter will be governed by the provisions of applicable law, while the other clauses will remain in force and continue to produce their effects.
12. Applicable law
These Terms and Conditions are governed by Romanian law.
13. Competent court
Any dispute arising from or in connection with your use of the Services will be resolved, to the extent permitted by law, by the competent courts in Romania.
